In these terms and conditions all references to 'company', "uCardit", 'us', our or 'we' means uCardit Limited (company number 5411577) whose place of business is at:

"Goods" means plastic personal information cards.
"Website" means this website www.ucardit.co.uk.
2 Formation Of Agreement
An agreement for us to sell you the Goods is made on the basis of these terms and conditions when we accept your order for Goods through the Website.
3.1 All orders are accepted at our sole discretion.
3.2 We will confirm receipt and acceptance of your order through our automatic screen confirmation of the order. This will followed by a confirmatory email.
4 Prices and Tax Charges
4.1 All prices on this Website are shown in pound sterling (£) and are inclusive of UK VAT at the current rate unless clearly stated otherwise.
4.2 Prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions.
5.1 Only payments made in pound sterling will be accepted.
5.2 All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Switch, Maestro and Solo. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and/or non-delivery of your order. We are unable to accept or process any credit/debit card orders without a valid card payment in the name of the registered cardholder.
5.3 All online payments are made through HSBC bank plc. After placing your order the server will transfer you to HSBCs Global Iris payment server through which you will make your payment. Once this has been done, you will be transferred back to the Website.
6 Orders out of stock
We aim to deliver products of the highest quality. From time to time we may be unable to meet our usual delivery times due to production issues, in which case we will advise you immediately. If this does occur, you will be given the opportunity to either:
1) have the products sent as soon as they become available, or
2) to cancel the order.
7.1 We deliver the Goods to addresses within the UK only. The price(s) quoted for the Goods are inclusive of delivery within the UK.
7.2 We shall attempt to deliver the Goods to the address you specify for delivery. It is important that the delivery address supplied by you to us is accurate. We accept no responsibility for Goods that fail to reach you because of an inaccurate address provided by you.
7.3 If you want the Goods delivered outside mainland UK, please contact us at the address above. Nothing in these terms and conditions, require us to accept an order.
8 Warranties and Indemnities
8.1 We warrant that the Goods shall be free from defects in materials and workmanship at the time of delivery.
8.2 You warrant that the content you provide to be incorporated into the Goods shall not contain any matter which infringes third party copyright or other intellectual property rights or any law (whether or not English) or third party right relating to defamation, fraud, malice, blasphemy, obscenity or misrepresentation and you agree to indemnify and hold us harmless against any claims brought by any third party resulting from the content provided by you.
8.3 Subject as expressly provided in these terms and conditions, all warranties, conditions or other terms, implied by statute or common law, are excluded to the fullest extent permitted.
9 Returns and Exchanges
9.1 If you receive Goods that are faulty or that have been damaged in transit, contact us as soon as possible, which shall be in any event no longer than 14 days after receipt of Goods at email@example.com stating your order number and the Goods that are damaged/faulty. Send the Goods back to us at the above address within a reasonable time, which shall be in any event no longer than 14 working days following receipt of the Goods. We will then credit your account for the damaged Goods or re-dispatch as appropriate. Your statutory rights are unaffected.
9.2 Since the Goods are made to your specifications, the Consumer Protection (Distance Selling) Regulations 2000 does not apply to these terms and conditions.
10.1 Please note that the Goods are printed automatically based on the information you provide to us. Although some Goods are checked randomly for the purposes of quality control, we take no responsibility whatsoever for the content of the Goods and we hereby exclude our liability for the content of the Goods to the fullest extent possible under applicable laws.
10.2 We will take all reasonable care to keep your order secure, but in the absence of our sole negligence we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data (including credit and account details) you provide when accessing or ordering from the Website.
10.3 We shall not be liable to you in connection with these terms and conditions in contract, tort (including negligence) or other wise for any loss of profit, anticipated savings or data (in each case whether direct or indirect) or any indirect or consequence loss.
10.4 Our aggregate liability to you in connection with these terms and conditions shall not exceed 5 times the value of the Goods ordered by you or 1000 whichever is greater.
10.5 Notwithstanding anything else in these terms and conditions, we accept unlimited liability in respect of death or personal injury caused by our negligence.
11 Force Majeure
We shall not be liable to you or in breach of these terms and conditions for delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control.
Any information displayed on the Website or other printed matter by the company is not regarded to be authoritative or certified as the best practice and is only considered to be useful supplementary advice to other certified codes of practice. All information on the Website is updated regularly.
13 Ownership of Goods
13.1 All items supplied to the customer remain the property of uCardit until final payment of all sums owing in respect of those Goods has been received in full by us.
13.2 Goods supplied are not for resale.
14 Intellectual Property Rights
14.1 The copyright in the material contain in the Website, together with the Website design, text and graphics and their selection and arrangement and all software compilations, underlying source code and software belongs to uCardit or the providers of such information. All rights are reserved. None of this material may be reproduced or redistributed without our written permission.
14.2 UCARDIT is a trade mark of the company. Other products or company names (if any) mentioned on the Website may be the trade mark or registered trade marks of their respective owners.
Any complaint can be communicated directly to us at the address stated above. We will endeavour to deal with your complaint within five working days of receipt.
16.1 We comply with all applicable data protection laws in the UK.
17.1 Entire Agreement
These terms and conditions (and the documents referred to in it) sets out the entire agreement and understanding between us in respect of the subject matter of this agreement. You acknowledge that you have entered into this agreement in reliance only upon the representations, warranties and promises specifically contained or incorporated in this Agreement and, save as expressly set out in these term and conditions, uCardit shall have no liability in respect of any other representation, warranty or promise made prior to the date this agreement is entered unless it was made fraudulently.
No purported variation of these terms and conditions shall be effective unless it is in writing and signed by or on behalf of each of the parties.
17.3 UN Convention
The 1980 UN Convention on the International Sale of Products to the extent it is other application in connection with these terms and conditions or any sales transaction under these terms and conditions is excluded in its entirety.
17.4 Exclusion of third party rights
No term of these terms and conditions is enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to it.
To the extent that any provision of these terms and conditions is found by any court or competent authority to be invalid, unlawful or unenforceable in any jurisdiction, that provision shall be deemed not to be part of these terms and conditions, it shall not affect the enforceability of the remainder of these terms and conditions nor shall it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.

These terms and conditions shall be governed by and construed in accordance with English law.
Any disputes shall be subject to the exclusive jurisdiction of the English courts, to which both parties submit.
